Jammu, 1st December 2025,— Bahujan Samaj Party (BSP) President for Jammu & Kashmir UT, Sh. Darshan Rana, has issued a strong objection to the recent statutory amendments introduced by the University of Jammu which allow non-domicile candidates to be considered for reserved category teaching posts, including Assistant Professor, Associate Professor, and Professor positions.
In a formal memorandum submitted to the Vice Chancellor of Jammu University, Darshan Rana stated that the amendments violate the constitutional safeguards and reservation framework established specifically for the reserved communities of the Union Territory of Jammu & Kashmir.
He said that the Reservation Rules of 2005, amended through S.O. 127 dated 24.04.2020 under The Jammu and Kashmir Reservation Act, 2004, clearly specify that reserved posts must be filled strictly by candidates belonging to the reserved categories of the J&K UT only. The Hon’ble High Court of Jammu & Kashmir and Ladakh has also upheld this domicile-based reservation as legally valid and constitutionally sound.
Rana further highlighted that no State University in India permits outsiders to compete for its reserved category seats, as these posts are meant exclusively for the upliftment of local marginalized communities. States such as Maharashtra, Tamil Nadu, Uttar Pradesh, and others strictly follow domicile-based reservation in higher education recruitment.
Allowing non-domiciles to apply for reserved posts in Jammu University, he said, will:
Undermine the rights of SC/ST/OBC/EWS reserved category candidates of J&K UT
Dilute the purpose of reservation meant for historically marginalized communities
Contradict established legal and administrative principles governing state-level recruitment
Cause injustice to thousands of deserving local candidates
Calling the amendments “anti-reservation, anti-social justice, and legally untenable,” Darshan Rana urged the University of Jammu to immediately withdraw the amendment and restore reservation protections for the reserved communities of the UT.
He stated that BSP will continue to stand firmly with the deprived and marginalized communities of J&K and will oppose any attempt to weaken reservation safeguards in government institutions.
